Dairy Disloyalty 2024 Terms and Conditions AUSTRALIA

1. Eligibility

Open to legal residents of the United States, United Kingdom, Ireland, France, Germany, Austria, Czech Republic, Denmark, and Australia, who:
(a) are 18 years or older at the time of entry; and
(b) provide a physical address in any of the aforementioned countries for delivery of the prize (if won) at the time of submitting their entry
(“Eligible Entrants”).

Void where prohibited by law.

The prizes and drawing of the prizes will be conducted for all international entrants on the same terms and conditions as set out below. In addition there may be country specific requirements as per local laws and regulations which are included below.


2. Competition Sponsor

Sponsored by Minor Figures Ltd (the “Sponsor”), located at Unit 12a, Minor Figures Uplands Business Park, Blackhorse Ln, London, UK E17 5QJ.

The Australian subsidiary of Minor Figures, Minor Figures Pty Ltd is the Australian promoter.
The United States subsidiary of Minor Figures, Minor Figures is the United States promoter.

 


3. Agreement to Rules

By entering this competition, participants agree to abide by these Terms and Conditions and decisions of Minor Figures, which are final and binding. Information on how to enter and prizes form part of these Terms and Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. These Terms and Conditions as well as

 


4. Competition Period

Start date: 12:01am AEST (Melbourne time) on Thursday 30 May 2024
Close date: 11:59pm PST (Los Angeles time) on Thursday 13 June 2024.

 


5. Competition Terms

5.1 How to Enter

Participants must complete the Minor Figures Dairy Disloyalty card in their city and submit a photo of the completed card, by using and completing the submission form (see: www.minorfigures.com/pages/dairy-disloyalty) in order to be eligible for prizes.

To complete the card, participants make a plant-based purchase at all 6 cafes in their city. Participants must purchase a plant-based coffee/specialty drink and obtain a stamp on the cafe's name box on their Minor Figures Dairy Disloyalty card. Each cafe has a different stamp, the stamp colour must be unique and correctly match the given cafe. Participants can obtain the Minor Figures Dairy Disloyalty card from the first cafe they visit.

After completing the card, participants must submit an image of the completed card, along with the full submission form, link to the form hosted on page:
minorfigures.com/pages/dairy-disloyalty. Participants will receive a "submission received" screen upon successful completion of the submission process.

No entry fee is charged by the Sponsor to enter the competition.


5.2 General Terms

Minor Figures Dairy Disloyalty cards stock is limited and only available at each cafe location while stocks last. Only plant-based coffees and specialty drink purchases are eligible for participants to receive a stamp. The opening hours of each cafe remain at the discretion of the cafe. Any lost Minor Figures Dairy Disloyalty cards will not be at the expense of the Sponsor, and any stamps obtained will be lost and will not be replaced at the expense of the Sponsor.

The Sponsor reserves the right to cancel, suspend, and/or modify the competition if fraud, technical failures, or any other factor impairs the integrity or proper functioning of the competition, as determined by the Sponsor in its sole discretion. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid. The Sponsor reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Sponsor to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered to that winner. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Sponsor’s discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.

Only complete Minor Figures Dairy Disloyalty cards submitted via the method listed in section 5 are eligible for the prizes. See section 5.1 for details on how to enter and card completion.

Only submissions that are complete and have been submitted by the close date by Eligible Entrants will be eligible. Entries are deemed to be received at the time of receipt by the Sponsor and not at the time of transmission by the entrant. Records of the Sponsor and its agencies are final and conclusive as to the time of receipt.

To be eligible for the prize draw, participants must have all 6 unique coloured stamps on the same card. Anything other than this will be disqualified.

Limit to one entry per person.

 


6. Prizes

6.1 Game of Skill – 100 Minor Prizes Worldwide

The first 100 Eligible Entrants to complete the card and submit the completed card via the form are eligible to win a custom bowling shirt with the breakdown per territory as follows:

The first 30 eligible entries (completed form submitted with an image of a completed Dairy Disloyalty card by an Eligible Entrant) submitted by a North American resident will win a limited edition Minor Figures bowling shirt.
The first 50 eligible entries (completed form submitted with an image of a completed Dairy Disloyalty card by an Eligible Entrant) submitted by a European resident will win a limited edition Minor Figures bowling shirt.
The first 20 eligible entries (completed form, submitted with an image of the completed Dairy Disloyalty card by an Eligible Entrant) submitted by an Asia-Pacific resident will win a limited edition Minor Figures bowling shirt.

The custom Minor Figures bowling shirts may not exactly reflect the imagery used on promotional materials.

Winners will be notified by email (as provided in the entry form) within 7 days of the final winner being awarded. Custom bowling shirts will be sent for delivery within 120 days of the closing date of the competition, subject to production delays. Any delays will be communicated to winners via their submitted email contact address. The Sponsor is not responsible for any errors stated in the addresses provided nor any damage or failure to delivery once sent out via post. Winners of the Minor Figures bowling shirt will not be published.

6.2 Game of Chance – One Major Prize Worldwide

All Eligible Entrants who submit a valid entry during the competition period will go into the running to win a La Marzocco Home espresso machine. A submission is considered valid when an Eligible Entrant completes their Dairy Disloyalty card in their city and submits an image of the card, as well as the complete submission form via with an image of a completed Dairy Disloyalty card. In Australia, entrants who indicate by way of delivery address that they are a resident of the ACT or South Australia are excluded from the major draw prize.

The La Marzocco Home machine may not exactly reflect the imagery used on promotional materials. If the prize is unavailable the Sponsor reserves the right to substitute the prize to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority. The prize will be sent for delivery within 120 days of the campaign completion subject to production delays. Any delays will be communicated to the winner via their submitted email contact address.


6.3 Draw and Notification for Major Prize

6.3.1 The winner of a major drawn prize is determined by chance.
6.3.2 The draw will take place at the Sponsor’s office at Unit 12a, Minor Figures Uplands Business Park, Blackhorse Ln, London, UK E17 5QJ using computerised random selection on 21 June 2024.
6.3.3 The first valid entry drawn will be the winner of the major prize, being the La Marzocco Home espresso machine.
6.3.4 The draw conductor may draw reserve winners in case of ineligible or invalid entries.
6.3.5 The Sponsor will ensure each draw is open for public scrutiny and any person may witness the draw upon making such request to the Sponsor prior to the draw taking place. For this purpose the Sponsor will post to its promotion page a link to view live the draw 48 hours prior to the draw taking place.
6.3.6 The winners will be notified in writing prior to 28 June 2024 of their win - reasonable attempts will be made to contact the winner. The Sponsor is not responsible for any incorrect or non-functioning contact information provided by entrants. The winner’s name, town and country will be posted on the Sponsor’s promotion page at www.minorfigures.com/pages/dairy-disloyalty within 7 days of the draw.
6.3.7 If the winner cannot be contacted within 30 days the next drawn reserve winner (as per point 4 above) will be deemed the major prize winner. The new winner’s name, town and country will be posted on the Sponsor’s promotion page within 7 days of the prize being awarded to them.

The value of the prize is accurate and based upon the recommended retail value of the prize at the date of printing, noting that the retail price if the prize can vary from country to country. No part of a prize is exchangeable, redeemable for cash or any other prize or transferable.

 


7. Odds of Winning

The odds of winning depend on the number of eligible entries received.

 


8. Rights Granted by Entrants

By entering, you consent to the Sponsor and its subsidiaries using your completed card submission image for promotional purposes in any media without payment or consideration.

 


9. Employees & Next of Kin

Employees of the Sponsor and their immediate family members are not eligible to participate.

 


10. Privacy and Data Protection

Data Collection and Use: By participating in this competition, entrants agree that the Sponsor may collect, process, store, and use personal data provided in their competition entry. This data includes but is not limited to, name, email address, and other contact details. This information will be used in accordance with the Privacy Policies of the Sponsor and its subsidiaries relevant to the entrant’s location. Unless specific marketing consent is provided at the time of entering the competition, the data will solely be used for the purposes of managing and administering the competition, verifying eligibility, and awarding prizes. The data collected in this game (Name, First Name, Email, Phone, Profession) is essential for proper prize management in case of winning.

Data Protection Rights: Participants have specific rights under countries’ privacy and data laws, which may include the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA) and the Australian Privacy Act 1988 (Cth). These include the right to access personal data, correct inaccuracies, request deletion, and object to the processing of personal data. Cross-Border Data Transfer: Personal data collected from entrants may be processed in any country where the Sponsor, its subsidiaries or its service providers maintain facilities. By participating in the competition, entrants consent to the transfer of their personal data to these countries, including those outside of the European Economic Area (EEA).

11. Limitation of Liability

By entering, participants release and hold harmless the Sponsor, its subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss, or damages of any kind arising from or in connection with the competition or any prize won, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

The Sponsor accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.



12. Disputes

In the event that there is a dispute concerning the conduct of the competition or claiming a prize, the Sponsor will resolve the dispute in direct consultation with the entrant. Any dispute or claim regarding the competition must be addressed by email to the Sponsor within a period not exceeding one month from the end of the competition date. Any dispute or claim received by the Sponsor after this deadline will not be considered. If the dispute cannot be resolved the Promoter’s decision will be final.

The Sponsor reserves the right to suspend, cancel, or amend the prize draw where it becomes necessary to do so, with no liability to any entrants or third parties. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of these rights.

This prize draw and all issues arising out of it shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the English courts where any dispute that cannot be resolved in accordance with these Conditions of Entry.

 


13. Social Media Platform Disclaimer

This promotion is in no way sponsored, endorsed, or administered by, or associated with, Instagram or any other social media platforms used throughout the competition.

 


14. Australia-specific terms

The competition is being specifically promoted in Sydney, NSW and Melbourne, VIC. The game of skill shirt competition is permitted to entrants from all Australian states. The major prize competition is permitted without the need to obtain permits or authorities in to entrants residing any state except SA or ACT. Total prize pool for game is skill competition is $1,200. Total prize pool for game of chance major prize competition is approximately $7,000.
